Agreement to Terms
By accessing and using Giftsgiftcreativ services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our services.
Services
Giftsgiftcreativ provides professional photography services including event photography, individual photo sessions, and document photos. All services are subject to availability and scheduling.
Booking and Payment
Bookings are confirmed upon receipt of payment or deposit as agreed. Payment terms will be specified at the time of booking. Cancellations must be made in accordance with our cancellation policy. All prices are subject to change without notice, but confirmed bookings will be honored at the agreed price.
Photography Content
Giftsgiftcreativ retains copyright to all photography content created during sessions. Clients receive usage rights as specified in their service agreement. Photography content will be delivered in the format and timeframe agreed upon. Unauthorized reproduction or distribution of photography content is prohibited.
Client Responsibilities
Clients are responsible for providing accurate information, arriving on time for sessions, and following any guidelines provided by Giftsgiftcreativ. Clients must obtain necessary permissions for photography locations when required. Clients are responsible for ensuring all participants have consented to photography.
Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Giftsgiftcreativ and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Limitation of Liability
Giftsgiftcreativ is not liable for circumstances beyond our control, including weather conditions, venue restrictions, or client cancellations. Our liability is limited to the value of services provided. We are not responsible for loss or damage to personal property during sessions.
Indemnification
You agree to indemnify and hold harmless Giftsgiftcreativ from any claims, damages, or expenses arising from your use of our services or violation of these terms.
Modifications
Giftsgiftcreativ reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms. We will notify users of significant changes via email or website notice.
Governing Law
These Terms of Use are governed by the laws of Ireland. Any disputes arising from these terms will be resolved in the courts of Ireland, with jurisdiction in Dublin.
Dispute Resolution
In the event of any dispute arising from these Terms of Use or our services, we encourage you to contact us first to resolve the matter amicably. If a dispute cannot be resolved through direct communication, the following procedures apply:
- Parties agree to attempt to resolve disputes through mediation before pursuing litigation
- If mediation fails, disputes will be resolved through binding arbitration in Dublin, Ireland
- You waive any right to participate in class action lawsuits against Giftsgiftcreativ
Service Modifications
Giftsgiftcreativ reserves the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.
Equipment and Property
Clients are responsible for the safety and security of their personal property during photography sessions. Giftsgiftcreativ is not responsible for loss or damage to client property, including clothing, jewelry, or other personal items. Clients must inform us of any valuable items that require special handling.
Weather and Outdoor Sessions
For outdoor photography sessions, weather conditions may affect the quality and feasibility of the session. In cases of severe weather, we reserve the right to reschedule sessions. We will work with clients to find alternative dates that accommodate both parties.
Image Delivery
Photography content will be delivered through our online gallery system or via agreed-upon methods. Delivery timelines will be specified at the time of booking. While we strive to meet all delivery deadlines, delays may occur due to unforeseen circumstances. We will communicate any delays promptly.
Re-editing and Revisions
Minor editing revisions may be requested within 14 days of image delivery. Extensive re-editing requests may incur additional fees. We will work with clients to ensure satisfaction while maintaining reasonable expectations regarding editing scope.
Model Releases
For commercial photography or portfolio use, we may require signed model releases from all subjects photographed. Clients are responsible for obtaining necessary releases from all participants, including minors (with parental consent).
Force Majeure
Giftsgiftcreativ shall not be liable for any failure or delay in performance under these Terms of Use resulting from acts beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or other force majeure events.
Severability
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
Entire Agreement
These Terms of Use, together with any service agreements or contracts, constitute the entire agreement between you and Giftsgiftcreativ regarding the use of our services and supersede all prior agreements and understandings.
